2008 Priority Bills - House
HB 473 (Bradley, R.) - Creates the Funding Accountability and Transparency Act. Requires the full disclosure of all entities and organizations receiving State funds. Requires the Governor's Office of Management and Budget (GOMB) to establish a searchable website. Creates a pilot program for sub-award data. Requires GOMB to file reports and the Governor to make recommendations to the General Assembly. Contains other provisions. Effective immediately. House Amendment No. 1 Provides that the term "State award" does not include moneys received by a retailer serving as a vendor as part of a reimbursement-only program for goods and services through the Department of Children and Family Services, the Department of Human Services, the Department of Healthcare and Family Services, the Department of Public Health, the Department on Aging, or any of their successor agencies. Senate Committee Amendment No. 1 Deletes everything after the enacting clause. Creates the Funding Accountability and Transparency Act. Contains only a short title provision. Senate Floor Amendment No. 2 Deletes everything after the enacting clause. Amends the State Finance Act, if and only if House Bill 3860 and House Bill 315 of the 95th General Assembly become law. Provides that, through June 30, 2008, the Governor may direct the State Comptroller and the State Treasurer to transfer moneys from certain special funds into the General Revenue Fund, subject to certain restrictions. Effective immediately. Senate Floor Amendment No. 3 Provides that the Governor may not transfer moneys from the Road Fund, the Open Space Lands Acquisition and Development Fund, and the Metabolic Screening and Treatment Fund to the General Revenue Fund. Senate Floor Amendment No. 4 Adds additional funds to the list of funds exempted from transfers to the General Revenue Fund. Passed the House on 4/18/2007 with a vote of 116-0. Passed the Senate on 4/3/2008 with a vote of 37-21.

HB 1058 (Burke, D.) - Amends the Department of Public Health Powers and Duties Law of the Civil Administrative Code of Illinois. Provides that the Department of Public Health has the power to make matching grants from the Heartsaver AED Fund to (i) any school, college, or university (instead of any public school, college, or university); (ii) any public park district; or (iii) any municipal recreation department, to assist in the purchase of an Automated External Defibrillator. Removes the requirement that the entity be "required to have" an AED to be eligible for the grant. Provides that any entity applying for a grant shall not receive more than one grant from the Heartsaver AED Fund each fiscal year (instead of per facility). Makes other changes. Effective immediately. Senate Committee Amendment No. 1 Provides that the Department of Public Health has the power to make matching grants from the Heartsaver AED Fund to any forest preserve district or conservation district. Provides that a forest preserve district or conservation district may only receive one grant from the Fund each fiscal year. Passed the Senate on 5/22/2007 with a vote of 48-5. On 3/6/2008 the House concurred with the Senate Committee Amendment 1 with a vote of 104-0.

HB 2094 (Madigan, M.) - With the passage of Illinois' Workers' Compensation Law, the Structural Work Act remained dormant until the 1950s, when an Illinois court decision struck down a provision that prohibited third party lawsuits. From that point, until its repeal in 1995, a worker could collect benefits under Workers' Compensation and then sue everyone involved in the project regardless of fault, including owners, suppliers, contractors, subcontractors and designers.

HB 2392 (Currie, B.) - Amends the Time Standardization Act. Provides that the State shall switch to and from Daylight Saving Time on the second Sunday in March (now, the last Sunday in April) and the first Sunday in November (now, the last Sunday in October), respectively. Effective immediately. House Amendment No. 2 Further amends the Time Standardization Act. Provides that, if the dates set forth under Illinois law for the beginning and ending of daylight saving time differ from the dates set forth under the federal Uniform Time Act of 1966, then the dates set forth under the federal law control and apply in Illinois. Passed the House on 4/17/2008 with a vote of 114-0. Passed the Senate on 5/20/2008 with a vote of 58-0.

HB 4219 (Munson, R.) - Creates the Identity Protection Act. Prohibits a State or local government agency from using an individual's social security number in certain ways, subject to various exceptions. Requires each State or local government agency to develop and implement an identity protection policy. Provides that any employee of a State or local government agency who intentionally violates the provisions of the Act is guilty of a Class A misdemeanor. Preempts the concurrent exercise of home rule powers. Amends the State Mandates Act to require implementation without reimbursement by the State. Effective immediately. House Amendment No. 1 Deletes everything after the enacting clause. Reinserts the substantive provisions of the bill with changes. Provides that certain provisions of the Identity Protection Act apply to social security numbers only (instead of social security numbers and other identifying information). Provides that a person who intentionally violates the prohibitions contained in the Act is guilty of a Class B misdemeanor (instead of a Class A misdemeanor). Makes technical changes. Provides that there is no rulemaking authority under the Act, but that the Governor may suggest rules by filing them with the General Assembly and requesting that the General Assembly authorize such rulemaking by law, enact the suggested rules into law, or take other appropriate action in the General Assembly's discretion. Effective immediately. Passed House on 3/4/2009 with a vote of 109-0.

HB 4283 (Holbrook, T.) - Amends the Township Code. Provides that certain bond proceeds shall be expended under the direction of the board of trustees of the township (instead of the highway commissioners of the township). Provides that the board of trustees of the township (instead of the highway commissioners of the township) may designate certain parcels of land to be used for the purchase of parks. Effective immediately. House Amendment No. 1 Provides that a majority of the members of the board of trustees of the township may designate that certain bond proceeds be expended under the direction and upon the warrant of the highway commissioner if the highway commissioner provides written consent to that action. HB 4583 (Ryg, K.) - Amends the Minimum Wage Law. In language providing that a day camp counselor is not subject to the adult minimum wage if specified requirements are met, deletes a phrase that limited the scope of the language to day camps of organized not-for-profit corporations. Passed the House on 4/2/2008 with a vote of 110-0. Passed the Senate on 5/27/2008 with a vote of 53-0.

HB 4664 (Leitch, D.) - Appropriates $12,000,000 from the Capital Development Bond Fund to the Department of Natural Resources for grants under the Public Museum Capital Grant Program. Appropriates $12,000,000 from the Capital Development Fund to the Department of Natural Resources for a grant to the Peoria Riverfront Museum for capital expenses. Effective July 1, 2008. HB 4757 (Nekritz, E.) - Creates the Transportation Enhancements and Safe Routes to School Transparency Act. Establishes grants review committees, appointed by the Secretary of Transportation, to evaluate, score, and rank all applications for funding under the federal Transportation Enhancements Program and the Safe Routes to School Program. Sets forth the grants review process. Provides that application evaluation, scoring, and ranking decisions of the committees are binding upon the Department. Contains other provisions. Effective immediately. House Amendment No. 1 Provides that neither the Governor nor any agency or agency head under the jurisdiction of the Governor has any rulemaking authority under the Act, but that the Governor may suggest rules by filing them with the General Assembly and requesting that the General Assembly authorize such rulemaking by law, enact the suggested rules into law, or take other appropriate action in the General Assembly's discretion. Passed the House on 4/2/2008 with a vote of 109-0.

HB 5310 (Bellock, P.) - Amends the Illinois Lake Management Program Act. Creates the Task Force on the Conservation and Quality of the Great Lakes for the protection of the water quality and supply of the Great Lakes. Sets forth the membership, powers, and duties of the Task Force. Effective immediately. House Amendment No. 1 Adds the Executive Director of the Illinois International Port District as a member of the Task Force. Provides that one member of the Task Force must be a representative of a national alliance organized for the purpose of protecting and preserving the Great Lakes (instead of a representative of the Alliance for Great Lakes). HB 5369 (May, K.) - Creates the Illinois Energy Efficiency and Conservation Block Grant Act. Provides that the Green Governments Coordinating Council, in conjunction with the Office of Lieutenant Governor, shall be the State governmental body responsible for applying for and distributing any and all energy efficiency and conservation grant money pursuant to the federal Energy Independence and Security Act of 2007. Sets forth the duties of the Green Governments Coordinating Council with respect to those grant moneys. Effective immediately. House Amendment No. 1 Provides that there is no rulemaking authority under the Act, but that the Governor may suggest rules by filing them with the General Assembly and requesting that the General Assembly authorize such rulemaking by law, enact the suggested rules into law, or take other appropriate action in the General Assembly's discretion. HB 5519 (Fritchey, J.) - Amends the Recreational Use of Land and Water Areas Act. Provides that the purpose of the Act is to make land and water areas available (instead of available to any individuals or members of the public) for recreational or conservation purposes by limiting liability to others. Provides that the definition of land does not include residential buildings (instead of residential buildings or residential property). Provides that recreational or conservation purpose means: (1) entry by individuals or members of the public (instead of entry) onto the land of another for hunting, recreational shooting, a related activity, or (2) entry by the general public onto the land of another for conservation, resource management, exercise, or educational purposes (instead of hunting, recreational shooting, or related activities). Effective immediately.

Provides that each appropriation for a legislative member initiative must be by a separate line item appropriation that fully describes the legislative member initiative. Provides that an appropriation for a legislative member initiative or a capital improvement is released and available for expenditure as a matter of law; and authorizes enforcement by mandamus maintained by any member of the General Assembly. HB 5950 (Munson, R.) - Creates the Eldercise Fitness Website Act. Provides that, subject to appropriation, the Department of Public Health and the Department on Aging, in cooperation with the Governor's Council on Physical Fitness, shall create an Internet-based statewide fitness program to educate and involve older citizens and their families in physical activities, as well as stress the importance of proper nutrition.

Provides that a person convicted of a felony violation of improper use of public funds is ineligible to receive any grant or contract from the State of Illinois. Defines "gubernatorial or legislative member initiative" and "infrastructure improvements".
